There needs to be a balance between protecting IP and crushing open source software. Before patents were introduced in the US way before I was born the argument against was that it would "stiffle invention and progress". Clearly that argumnet was wrong.
What's the middle ground?
Software field is very different than industry one.
So reflexions about industry patents can't apply to softwares one.
A software is deprecated in few months. An industriy innovation is deprecated in many years.
If you want to apply patents to softwares world, you should make them last one or two months.
That's stupid : just remove them as all experts ask...
