I got this from the other forums and would like to know what your brains can contribute to it.

The discussion should hopefully go beyond legality and extend to philosophy.

This question has a lot of dimensions, and unfortunately many of them are way outside of my realm of expertise. Here are some questions that i can offer suggestions on.


Is there anything inherently wrong with granting an entity or organization legal personhood?

No. In fact, i commend the idea.

i can't help but chuckle slightly when i read wording like "a corporation is a legal fiction", and the author has completely missed the irony of that statement. "A legal fiction"? ^_^; Dude, law itself is a fiction. It is a constructed artefact that has no real existence except by enforcement. If a law "exists" and no one or nothing enforces it... then it just doesn't exist.

If the law said i was not a person... does that make it true? ^_^; Hardly.

Law exists to provide social equality and for the protection of society. If granting a corporation, an intelligent computer program, or an extra-terrestrial, personhood provides social equality and/or protects society, then i say go for it. According to the law, atheism is a religion. Does that actually make atheism a religion? No, of course not. ^_^; But because religions are granted benefits, social equality demands that "non-religion" religions should be granted the same benefits. Why not? Go for it. It doesn't do anything except enforce equality.

So that means the question is:


Does granting corporations personhood provide social equality and/or protect society?

No clue. But, for those that have more knowledge than me, and an inclination toward this field, it's a good place to start.
