torrents are just a protocol, it depends on the content if they are legal or not. Same with http, you can also transfer illegal content over that.

Torrent protocol and torrents are absolutely legal. They can be used to share completely legal and free files. But if you use them for downloading or uploading cracked games, movies, music, etc. then they are illegal. It always depends on content.
Torrents are a tool. I don't think that is being communicated effectively.
What that tool is used for is the sole responsibility of the user. Torrents are 100% legal just like Usenet is 100% legal. When these are used to distribute copyright material then we have problems.
Guns are legal to buy and own in most places around the US but things change when you start waving them around in public and/or in peoples faces.
