Why should it be illegal? Software is free. The only thing that is illegal is the thing that people share/ That's it.

I think the question is where, i mean in what country, because there is not a global law. Every country has this own.

P2P software is completely legal. It is just what you are downloading with it. Some uses it to download iso for Linux, and that is perfectly legal no matter you see it from which view.
Maybe you mean the file download by e-mule but not the e-mule software itself. Some pic, mp3, video and software is legal, but lots of file can download by e-mule is not.
P2P technology is perfectly legal. the problem lies that people use these software to share illegal stuff. the MPAA and RIAA have constantly said that it is illegal, to discourage downloads using P2P software.

I have not yet read the entire case, but it rises two questions in my mind
* If one p2p client is or was "illegal", then maybe all p2p clients are illegal
* From where would/could kazaa, with their relatively small number of paying users, get $100 million and willingly part with it? Something is fishy here. I smell a MPAA and RIAA scam.
