WEST PALM BEACH, Fla. - An ice cream truck driver who fled after a 2-year-old boy ran in front of her truck and was killed has been sentenced to six months in jail.
Angela Rodriguez, 28, pleaded guilty Thursday to leaving the scene of a crash involving a death. She entered the plea after a jury was unable to reach a verdict following five hours of deliberations.
Rodriguez is scheduled to report to jail April 6 and then serve six months of house arrest.
Authorities say her ice cream truck struck the boy, Moses Joseph, after he wandered into her path near his apartment complex in March 2005. Moses died at the scene.
Rodriguez testified that she briefly picked up the boy, but became scared and drove away when residents of the apartment complex began yelling at her. She later turned herself in.
The boy’s mother, Emmanuelle Richard, 21, said she was not happy with the plea deal.
“It was a mistake,” Richard said. “But the fact is she ran. She didn’t call 911. The only thing she cared about was herself. It’s like my son was not a human being. She showed no remorse for my child, and for me.” |

You mean a human, the above person was female, not male. I think that the sentence was fair enough, she did not murder him, he ran in front of her truck so technically it wasn't her fault. What was her fault was the fact that she ran from the seen. It is easy for people to try and judge her but nobody, including the jury, wouldn't know what it was like for her, including me. We can only guess. She probably felt scared which was why she ran, nevertheless, i do not think that she acted in the correct way.
I don't know how you could live with knowing that you killed somone. Especially when it is a two year old. Its a shame that the kid didn't get to live a normal life. But why would you leave the scene of the crime.
in this state (MA-US) vehicular homicide carries a mximum of 18 years, since she left the scene of the accident there would have been additional charges on top of that...and rightly so. I can understand she was probobly scared, but the heck was going through her mind?? House arrest is too lenient a sentence for her.
In a crisis situation, people make irrational descisions. It's happened thousands of times before, it will happen again. Not really a major surprise there 
As long as it wasnt his fault and he couldnt have done anything, He should have stayed, Called 911. He probably wouldnt be charged because the 2 yr old just ran. It wasnt his fault, It wasnt expected.
But on the other hand, He is most likely to get fired even if it wasnt his fault. He would have a bad image since people would look at him as a murderer and you can expect the family of the victim to be an enemy.
